We want to ensure that our users (“you”), whether acting as employers or applicants, are treated fairly and with dignity throughout the screening and hiring processes, especially when using our website.
As a part of that, we are committed to protecting your privacy and ensuring that the information we collect to operate this website and provide applicants and employers with our job posting, skills testing, and other services, which includes some information which could be considered private or sensitive, is handled with care.
The purpose of this Privacy Policy is to explain what information we collect, why we collect it, how we use it, with whom we disclose that information, and to help you understand your rights and responsibilities regarding the personal information we collect from you.
This Privacy Policy applies to personal Information, as defined by applicable law, we collect from you when you visit this website, www.meritfinder.com (the “Website”) or which we may collect from you in the course of providing our various services, including job posting and skills testing, through the Website (the “Services”).
1.3. What this Policy Does Not Cover1.3.1. Non-Personal InformationIn some cases when you visit the Website or use the Services, we may collect some data which is not considered personal information under applicable law. For example, the information you may enter as an answer to a question in a skills test would not be considered personal information. Similarly, in some cases, we may also collect, use, and disclose to others certain aggregated consumer information or deidentified information, which would not be considered personal information under applicable law.
While we may afford non-personal information similar protections against disclosure or misuse, and may use it for similar purposes, and some of the types of information described in this Privacy Policy may not be defined as personal information under applicable law, this Privacy Policy is provided for informational purposes, is intended to describe our use, collection, and disclosure of personal information, and we reserve the right to collect, use, and disclose information which is not personal information at our discretion.
In some cases, you may use the Services to communicate with other users or to share documents or other sources of information with those users that contain your personal information, such as when uploading a CV or portfolio for review by an employer or responding to a voluntary disclosure form regarding veteran status or status regarding disabilities.
If you use the Services to communicate with other users, including employers, and you disclose personal information to those other parties, we cannot ensure that they will protect that information against disclosure or use it in accordance with our Privacy Policy, and as such, we are not responsible for other parties’ use of personal information that you share with those other parties.
We may provide links to third party websites. Those sites may have their own privacy policies or similar policies or terms of use. This Privacy Policy does not govern, and we are not responsible for, those third parties’ use of personal information.

Use by Minors Not PermittedThis Website and our Services not intended for children or persons under the age of 18, and we do not knowingly collect, use, or solicit personal information from people under the age of 18, or allow them to use the Services. Usage of the Services by people under the age of 18, or usage of the Services by persons to knowingly contact persons under the age of 18, violates our Terms of Use. If you become aware that a person is engaging in any such behavior in violation of our Terms of Use, we encourage you to report the violation using the methods set out in the Terms of Use, or using the contact information set out in Section 6. “Account Creation and Maintenance” refers to activity undertaken to create and maintain user accounts.
“Improving and Maintaining Website/Services” refers to the activities we undertake to operate, maintain, and improve upon our Website and associated Services, and to improve the security of the systems associated with our Website and Services. For example, we collect users’ IP addresses to detect irregular or suspicious activity, such as a DDoS attack, for security purposes. We may also use biometric information in an aggregated format to improve our facial recognition tools.
“Providing Services” refers to activities undertaken so that we can provide you and other users with the services offered through this Website. This could include (but is not limited to) services such as matching applicants with potential jobs, or our provision of skills tests. For example, in order to ensure the integrity of our skills testing services, we may ask to access your camera, and ask that you show us your face and hold up your ID so that we can attempt to verify your identity by comparing the ID with face on the camera or the biometric data we have collected in the past.
“Payments” refers to activities relating to our receipt of payments from employers for their use of the Services.
We may collect certain information from you which is considered sensitive personal information under applicable law. This may include information concerning your health or disability status, gender or sexual orientation, or racial or ethnic origin. We collect that information when requested by employers, and your provision of such information is entirely voluntary.
We may also collect that information regarding your citizenship or immigration status, and disclose that information to employers, as may be required by employers, as part of the Services to employers and applicants, to determine an applicant’s eligibility to work in certain regions.
In all cases, unless you provide us with additional permissions, we will only use your sensitive personal information and disclose it to other users, including employers, for the purposes of providing the Services, or, if you consent to providing that information to us in addition to an employer, we may use the information in an aggregated and de-identified form for the purposes of improving our Website (for example, by analyzing which populations are using our Services and how they might be better served).
In some cases, we may need to collect personal information from you, either because it is required by law, or because our collection and use of that information is required for us to perform some activity in accordance with the terms of a contract we have with you, such as would be the case for us to provide you with the Services under the Terms of Use applicable to you. If that is the case, and you do not wish to provide us with that personal information, we may not be able to perform those activities, and so, we may need to terminate your access to those Services. Accordingly, if you use those Services, then as a condition of our performance of those Services, you consent to our collection and use of that personal information.

How We Share Your Data (We Don’t Sell It)You should know that in many cases, we will disclose your personal information directly with other users to provide you and those users with the Services, such as when sharing an applicant’s name or other information with employers for their consideration for a job opening.
But, except for making some personal information available to employers when they use the Services, we will not sell your personal information, and will not sell it to any third parties for them to use for marketing purposes.
It is a violation of our Terms of User for users, including employers, to use personal information that they receive through the Services for marketing purposes. If you have reason that another user is violating the Terms of User applicable to them, such as if you are receiving marketing communications from an employer with whom you were connected through the Services without your subscribing to those communications through their website, please contact us using the methods described in Section 6, and we will investigate the matter and take remedial measures, which may include terminating that user’s access to the Services.
In certain jurisdictions, with some limitations and exceptions permitted to us by law, you may have the right to request access to the personal information we collect about you, request that we correct that information, or request the deletion of that information. You may make such a request by contacting us using the methods described in Section 6 below, and including “Personal Information Request” in the subject line. You can make such a request up to two times per year free of charge.
For us to adequately respond to such a request, we will need to verify your identity or authority to make the request to confirm that you are the subject of the personal information. As such, we may request additional information or documentation from you so that we can reasonably verify your identity. As may be required by the applicable laws of your jurisdiction, we will notify you if we learn that the security of your personal information has been breached. If you believe that your login credentials or other personal information we collected from you has been compromised, you should contact us using the methods described in Section 6.

7. Changes to Privacy PolicyWe will review our practices regarding the collection and use of personal information from time to time, and reserve the right to change this Privacy Policy at any time. If we make material changes to this Privacy Policy, and you have an account with us with a valid email address associated with that account, we will attempt to notify you of the change using that email address. Changes to this Privacy Policy will be effective as of the date they are posted to the Website.
You acknowledge that you need to keep your account up to date, including ensuring that it is associated with a valid current email address, and also, that you are responsible for reviewing this Privacy Policy and the Terms of Use applicable to you periodically to ensure that you understand out Privacy Policy and the terms applicable to you, and note any changes that have been made.
